1. Acceptance of Terms

By accessing and using JF Monitor ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.

2. Description of Service

JF Monitor provides website monitoring services, including but not limited to:

  • Uptime monitoring and availability checks
  • Content change detection
  • Performance and response time tracking
  • Alert notifications via email and Telegram
  • SLA reporting and analytics

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete registration information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Monitor websites you do not own or have permission to monitor
  • Attempt to circumvent any security features or limitations
  • Use the Service to send spam or unsolicited communications
  • Interfere with or disrupt the Service or servers
  • Transmit any viruses, malware, or harmful code
  • Violate any applicable laws or regulations
  • Resell or redistribute the Service without authorization

5. Service Availability

While we strive to provide reliable service, we do not guarantee that the Service will be:

  • Available at all times without interruption
  • Error-free or free from bugs or technical issues
  • Able to detect all website outages or changes
  • Delivered with specific response times or accuracy levels

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JF MONITOR SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions, delays, or unavailability
  • Inaccurate monitoring results or missed alerts
  • Damages resulting from your use or inability to use the Service
  • Third-party actions or services (including but not limited to Brevo, Telegram, or monitored websites)
  • Unauthorized access to or alteration of your data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST TWELVE (12) MONTHS, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS LESS.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of accuracy, reliability, or completeness
  • Warranties of uninterrupted or error-free operation
  • Warranties regarding the security of data transmission

You acknowledge that monitoring results may contain errors, omissions, or delays, and should not be solely relied upon for critical business decisions.

8. Indemnification

You agree to indemnify, defend, and hold harmless JF Monitor, its operators, affiliates, and service providers from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your monitoring of websites without proper authorization

9. Monitoring Accuracy and Limitations

You acknowledge and agree that:

  • Monitoring checks may be delayed, missed, or inaccurate due to network conditions, service outages, or technical limitations
  • The Service uses automated retry logic (3 attempts) which may delay incident detection by up to 40 seconds
  • Content change detection may produce false positives or miss legitimate changes
  • Alert delivery depends on third-party services (email providers, Telegram) which may fail or be delayed
  • The Service cannot detect all types of website issues or content modifications
  • You should implement redundant monitoring solutions for critical systems

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

11. Intellectual Property

The Service, including all content, features, and functionality, is owned by JF Monitor and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without express written permission.

12. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator is located, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and JF Monitor regarding the use of the Service and supersede all prior agreements and understandings.
